The Supreme Court of India has directed Coal India Limited to create a suitable post for a woman with disabilities at its Assam unit, reinforcing the rights of persons with disabilities to fair employment and reasonable accommodation.
The court observed that public sector undertakings have a statutory and constitutional obligation to ensure inclusivity and non-discrimination in recruitment and service matters. It noted that administrative or procedural hurdles cannot be used to deny employment to a qualified candidate solely on the ground of disability.
As per the order, Coal India has been asked to identify or create an appropriate position consistent with the woman’s qualifications and physical condition, and to ensure that service benefits are extended in accordance with applicable rules. The judgment is being seen as a significant affirmation of disability rights and is expected to have wider implications for employment practices across government-owned enterprises.
